1. Acceptance of Terms

By downloading, installing, or using the HYBRYD application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

HYBRYD is an AI-powered fitness training application that generates personalized hybrid training plans (combining strength and endurance training) based on biometric data from connected wearable devices and user input. The App uses artificial intelligence to adapt training recommendations based on recovery status, training history, and user preferences.

3. Not Medical Advice

HYBRYD is a fitness tool, not a medical device. The training plans, recovery recommendations, and coaching provided by the App are generated by artificial intelligence and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any exercise program. If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention.

4. User Accounts

To use HYBRYD, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information

• Keep your login credentials secure

• Notify us immediately of any unauthorized use

• Be at least 16 years of age

5. Subscriptions & Payments

HYBRYD may offer subscription-based access to premium features. Subscriptions are billed through the Apple App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your Apple ID settings.

6. Third-Party Integrations

The App integrates with third-party services including WHOOP, Strava, and Garmin. Your use of these integrations is subject to the respective terms of service and privacy policies of those third parties. We are not responsible for the availability, accuracy, or reliability of data provided by third-party services.

7. AI-Generated Content

Training plans, coaching responses, and recommendations are generated by artificial intelligence (Claude by Anthropic). While we strive for accuracy and safety, AI-generated content may occasionally contain errors or suboptimal recommendations. You acknowledge that AI-generated training plans are suggestions and should be evaluated using your own judgment and experience.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose

• Attempt to reverse engineer, decompile, or disassemble the App

• Interfere with or disrupt the App's infrastructure

• Share your account with others or create multiple accounts

• Use the App to develop a competing product

9. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, software, and AI-generated training plans — are owned by HYBRYD and are protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, HYBRYD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of profits, arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Assumption of Risk

Physical exercise carries inherent risks including but not limited to muscle strain, joint injury, cardiovascular events, and overtraining. By using HYBRYD, you acknowledge these risks and assume full responsibility for your physical activities. You confirm that you are physically capable of performing exercise and have no medical conditions that would prevent safe participation.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of the state in which HYBRYD is incorporated.
